Human rights lawyer, Mr. Femi Falana
(SAN), has faulted the position of the Federal Capital Development
Authority on the demolition of 500 housing units in Minanuel Estate,
Goza, Lugbe phase 11, Abuja.
He called for a public apology and
“payment of adequate financial compensation to atone for the demolition
carried out by FCDA without a valid order of a court of competent
jurisdiction”.
A statement by Falana on Thursday said
the action of the Development Control Department of the FCTA had
contravened laid down rules and regulations relating to eviction and
demolition of property.
Falana maintained that the estate
developer was not issued with any Stop Work Notice, Notice to Quit and
Demolition Notice, contrary to the assertion by the FCT administration
earlier this week.
He therefore challenged the FCT Minister
to provide evidence to prove the claim that those notices were served
on Minanuel Estate Limited.
Falana said even if the notices were
served, the demolition was still illegal as “no government, authority or
person has the power to eject any person from any property in the
Federal Capital Territory without recourse to the rule of law”.
