FOR allegedly forging the West African Examinations Council
(WAEC) result belonging to a former Speaker of Delta State House of
Assembly, Prince Olisa Enebeli Imegwu, four persons have been docked
before Chief Magistrate Sylvester Ehikwe in Asaba.
The suspects, Paul Chibogu (63), Ossai Abey (70), Mgbadike Godday
(52) and Raphael Nduka Opute (68), were arraigned yesterday on 15-count
charge ranging from certificate forgery, false publication, false
declaration, fabrication of evidence in judicial proceedings and false
testimony on oath, and knowingly tendering them in evidence with the
intent to mislead an electoral tribunal.
They were accused of trying to facilitate the removal and
substitution of the ex-Speaker as the candidate of the opposition
Democratic Peoples Party (DPP) for Ndokwa/Ukwuani Federal Constituency
of Delta State in the 2011 election.
According to the Suit No: CMA/615/2012 between the Commissioner of
Police VS Paul Chibogu, Ossai Abey, Mgbadike Godday and Raphael Nduka
Opute, the accused persons and others now at large had on February 11,
2011, in Asaba “fraudulently altered a forged WAEC result credited to
one Obi Olisa with candidate number 15803/332” purportedly issued by
WAEC “so that it will be acted upon as genuine.”
They were accused of “fraudulently altering a forged letter of
confirmation of result with reference number L/PCE/SR/3/VOL.467/175
dated February 11, 2011, credited to one Obi Olisa with candidate number
15803/332, purported to have been issued by the above mentioned council
to the secretary of DPP, Delta State, so that it will be acted upon as
genuine.
The offences, according to the charge sheet, are punishable under
relevant sections of the Criminal Code Law Cap. C21 Vol. 1, Laws of
Delta State of Nigeria, 2006. The accused persons pleaded not guilty
while Ehikwe adjourned the matter till February 14.
